Nota Simple

Nota Simple —

(Ocupas)

✓Nota Simple —

Risks when buying property in Spain: what to check before the deal

Spain is a popular destination for property buyers. But the market has traps that buyers discover only after the deal. Here are the main risks and how to protect yourself.

Risk 1. Hidden debts and encumbrances

The most common risk. Debts come in two types:

Registered in the property register — visible in Nota Simple

📋Mortgage — transfers to the new owner if not paid off before the deal
📋Court-ordered seizures
📋Easements and usage restrictions

NOT in the register — checked separately

⚠️Debts to the comunidad de propietarios (homeowners association) — by law pass to the new owner, up to 3 years back
⚠️Unpaid IBI (annual property tax)
⚠️Utility debts (electricity, water, gas)

Always order a fresh Nota Simple, 24–48 hours before the notary. The situation can change overnight — a new seizure can appear in the morning.

Risk 2. Squatters (Ocupas)

Squatters are people who have occupied someone else's property without permission. This is especially common in Catalonia, Madrid and tourist areas.

The main danger: if you buy a flat with squatters, evicting them through the courts can take 1–2 years. Police cannot evict them immediately without a court order.

How to check

✓Personally inspect the property immediately before signing (not a month earlier)
✓Check that the locks have not been changed
✓Look for signs of occupancy (mail, belongings, signs of forced entry)

Risk 3. Tenants with a valid rental agreement

A tenant with a legal rental contract is not a squatter, but still a problem. Under Spanish law, when the owner changes, the tenant retains the right to live in the flat until the end of the contract term (including automatic renewals under the LAU).

✓Check whether there is an active rental agreement
✓Verify the expiry date and termination conditions
✓Check whether the agreement is registered in the property register

Risk 4. Illegal renovations and planning violations

Unauthorised renovations are common in Spain — removed walls, extensions, layout changes without a permit. The new owner inherits these violations and may receive a notice to bring the property into compliance — at their own expense.

✓Check that the layout matches the register and cadastre data
✓Verify the renovation licence (licencia de obra)
✓For houses — check the occupancy permit (licencia de primera ocupación)

Risk 5. The seller is not the sole owner

The property may belong to multiple owners (inheritance, divorce, joint purchase). If even one of them refuses to sign — the deal will fall through or be contested.

✓Check Nota Simple: how many owners and what their shares are
✓Confirm that all owners have agreed to sell

Risk 6. Property under seizure or in bankruptcy

If the seller is a company in bankruptcy proceedings, or the property has a debt-related seizure, the deal may be challenged after completion.

✓Nota Simple — check for seizures
✓Company register (Registro Mercantil) — if the seller is a legal entity

How to protect yourself

✓Order a fresh Nota Simple before signing each contract
✓Request a certificate of no debts to the homeowners association
✓Get proof of IBI payment for recent years
✓Personally inspect the property before the final notary appointment
✓Check rental agreements
✓Hire an independent lawyer to review all documents
