Nota Simple

Nota Simple

(Titular)

(Cargas)

Nota Simple

Nota Simple

Nota Simple

Nota Simple in Spain: what it is and what to check before buying

Nota Simple is the first document to request before buying any property in Spain. Here is what it contains — and why it is not enough on its own.

What is Nota Simple

Nota Simple is an extract from the Spanish Property Register (Registro de la Propiedad). It shows the legal status of the property at the time of the request.

It costs around €10 and can be ordered online at registradores.org or through a notary or lawyer.

What Nota Simple contains

1. Property description

📌Exact address and cadastral reference number
📌Area according to the register (may differ from actual)
📌Property type (flat, house, garage, commercial)
📌Floor, number, share in common areas

2. Owner (Titular)

📌Full name and DNI/NIE of the owner or all co-owners
📌Each co-owner's share
📌How it was acquired (purchase, inheritance, gift)

3. Encumbrances (Cargas)

📌Mortgage — bank, amount, terms
📌Court-ordered seizures and restrictions
📌Easements (right of way, access, etc.)
📌Pre-emption rights

What Nota Simple does NOT show

This is important — Nota Simple is not the complete picture:

❌Debts to the comunidad de propietarios (homeowners association)
❌Unpaid IBI (annual property tax)
❌Utility debts
❌Tenants (a rental agreement may not be registered)
❌Illegal renovations (the register only records what it is told)
❌Squatters

These need to be checked separately.

When to order Nota Simple

✓Before signing the Contrato de Arras — to verify the property is clean
✓24–48 hours before the notary — again, because the situation may have changed

Do not order once "just in case" a month before the deal — the data becomes outdated.

Who can order it

Anyone — Nota Simple is a public document. You do not need to be the owner or have a power of attorney.

What to do with the document

Nota Simple is written in Spanish legal language. Without experience it is hard to correctly interpret encumbrances, mortgage terms and easements. That is why it is important to have a lawyer review it.
